Divorce   

If you want a divorce, you will get one. If your spouse wants a divorce and you don’t, they will get one. Hawaii is a no-fault state. If one party wants out there is going to be divorce.

Children 

Don’t fool yourself, children are adversely affected when parents separate whether in a divorce or a paternity. If the parents cannot agree on how to share the children, the court will decide. Hawaii law states: “Custody should be awarded to either parent or to both parents according to the best interests of the child, and the court also may consider frequent, continuing, and meaningful contact of each parent with the child unless the court finds that a parent is unable to act in the best interest of the child.” What does this mean? Hawaii follows the partnership model, which means a 50/50 split in the division of the family’s assets and debts but with some important exceptions.
